GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale govern purchases made through the Onyou online store.

2. SCOPE OF APPLICATION

These Terms apply to online sales of products made through the Onyou website to consumer customers.

A consumer is a natural person acting for purposes outside their trade, business, craft or profession.

Sales to professionals, companies, organisations or resellers may be subject to different contractual conditions.

The customer is invited to read these Terms, the Returns, Size Exchanges and Refunds Policy, the Shipping and Delivery Policy and the Privacy Policy before placing an order.

By submitting an order, the customer confirms that the information provided is accurate and that the customer has read the contractual information made available before purchase.


3. PRODUCT INFORMATION

The main characteristics of each product are described on the relevant product page.

Customers should review the product description, available sizes, materials, care information and any product-specific restrictions before placing an order.

Product images are provided for descriptive purposes.

Colours and details may appear slightly different depending on photography, lighting, screen settings, production variations or updates introduced by the manufacturer.

Minor differences that do not affect the essential characteristics or conformity of the product do not constitute a defect.


4. PRODUCT AVAILABILITY

Product availability is updated on the website but may change because of simultaneous purchases, inventory-synchronisation delays, stock errors, damage discovered during order preparation or other operational circumstances.

Adding a product to the cart or wishlist does not reserve it.

If a product becomes unavailable after an order has been submitted, Onyou will contact the customer and may offer:

- an alternative available product;
- a replacement size or variation;
- partial fulfilment of the order;
- cancellation and refund of the unavailable product.

No substitute product will be supplied without the customer’s agreement.


5. PRICES

Product prices are displayed in the currency selected or made available for the customer’s market.

For deliveries within the European Union, displayed consumer prices include applicable VAT unless otherwise stated.

For deliveries outside the European Union, VAT treatment may depend on the destination and the configuration shown at checkout.

Shipping costs, free-shipping thresholds and any additional charges collected by Onyou are displayed before the order is confirmed.

For destinations outside the European Union, customs duties, import taxes, brokerage charges and other local costs may be charged by the destination country.

Unless expressly stated otherwise at checkout, these charges are not included in the product price and are borne by the recipient.

Onyou may correct obvious typographical, technical or pricing errors.

If an obvious error affects an order already submitted, Onyou will contact the customer before fulfilment and offer confirmation at the correct price or cancellation with a full refund.


6. PROMOTIONS AND DISCOUNT CODES

Promotions, discount codes and special offers are valid only under the conditions communicated when they are issued.

They may be subject to:

- expiry dates;
- minimum order values;
- market or customer restrictions;
- product or brand exclusions;
- single-use restrictions;
- restrictions on combination with other promotions.

Unless expressly stated otherwise, promotional codes cannot be combined with other codes or offers.

Onyou may refuse or cancel the improper, fraudulent or unauthorised use of a discount code, without prejudice to mandatory consumer rights.


7. ORDER PROCESS

To place an order, the customer selects the products, chooses the available options, enters the required contact, billing and delivery information and completes the checkout process.

Before confirming the order, the customer can review and correct:

- the selected products;
- sizes, variations and quantities;
- product prices;
- discounts;
- shipping charges;
- billing and delivery details;
- the total payable amount.

The customer is responsible for checking that the selected size, product variation, delivery address, email address and telephone number are correct.


8. CONCLUSION OF THE CONTRACT

Submission of the order constitutes an offer by the customer to purchase the selected products.

The purchase contract is concluded when Onyou sends the customer an order confirmation by email, subject to successful payment and the checks described in these Terms.

Onyou may decline or cancel an order in the event of:

- product unavailability;
- failed or incomplete payment;
- incorrect or incomplete customer information;
- an obvious pricing or description error;
- suspected fraud or unauthorised payment;
- quantities inconsistent with normal consumer use;
- shipping or legal restrictions affecting the destination;
- other objective operational or legal reasons.

If an order is declined or cancelled after payment, Onyou will refund the amount due using the original payment method.


9. ORDER CANCELLATION BEFORE FULFILMENT

Where the relevant function is available in the customer account, the customer may request cancellation until the products have been fulfilled.

A cancellation request is not guaranteed if order preparation has already started or if the parcel has already been handed to the carrier.

If the cancellation is accepted after payment, Onyou will refund the amount due using the original payment method.

If the order can no longer be cancelled, the customer may exercise the statutory right of withdrawal after delivery according to the Returns, Size Exchanges and Refunds Policy.


10. PAYMENT

Payment must be made using one of the methods available at checkout.

The order will normally be processed only after payment has been successfully authorised or confirmed.

Where payment is provided through a third-party service, including an instalment-payment provider, the customer may also be subject to the terms and conditions of that provider.

Onyou does not directly store complete payment-card information where payment is processed by an authorised third-party provider.

If a payment is refused, reversed, disputed or identified as unauthorised, Onyou may suspend or cancel the order and request further verification.


11. SHIPPING AND DELIVERY

Shipping methods, rates, free-shipping thresholds and indicative delivery times are described in the Shipping and Delivery Policy.

Unless otherwise agreed, Onyou will deliver the products without undue delay and no later than 30 days from conclusion of the contract.

Delivery dates and times are estimates unless expressly agreed as binding.

The customer must provide a complete and accurate delivery address and any information reasonably required by the carrier.

Onyou is not responsible for delays caused by incorrect or incomplete information supplied by the customer, customs controls, strikes, extreme weather, force majeure or other circumstances beyond its reasonable control.


12. TRANSFER OF RISK

Where transport is arranged by Onyou, the risk of loss of or damage to the products remains with Onyou until the products are physically delivered to the customer or to a third party designated by the customer, other than the carrier.

If the customer independently appoints a carrier that was not offered by Onyou, risk may transfer when the products are handed to that carrier, in accordance with applicable law.


13. IN-STORE PICKUP

Where available at checkout, the customer may choose in-store pickup at:

The customer will receive notification when the order is ready for collection.

Onyou may request the order confirmation and a valid identity document before releasing the order.

If another person collects the order, Onyou may request written authorisation and identification for both the customer and the authorised person.


14. RIGHT OF WITHDRAWAL

Consumer customers may withdraw from the purchase contract within 14 days without giving any reason, subject to the conditions and exceptions described in the Returns, Size Exchanges and Refunds Policy.

The customer may exercise the right of withdrawal through the online Return Center or by sending another clear and unequivocal statement to Onyou.

The customer must return the products without undue delay and no later than 14 days after communicating the withdrawal.


15. RETURN SHIPPING COSTS

For a return caused by a change of mind, personal preference or incorrect size selection, the direct return-shipping cost is borne by the customer.

The customer may use:

- a traceable courier of their choice; or
- an Onyou return label, where available, subject to the contribution stated in the Returns, Size Exchanges and Refunds Policy.

When an Onyou label is used for a return for refund, the applicable contribution may be deducted from the refund.


16. FIRST FREE SIZE EXCHANGE

Onyou provides one free first size exchange as a voluntary commercial service for orders meeting the following merchandise-value thresholds:

- Italy: €100.00
- European Union: €250.00
- European countries outside the European Union: €500.00
- All other countries: €500.00

The threshold is calculated using the price actually paid for the products after discounts, excluding shipping charges, duties, import taxes, gift-card purchases and additional services.

The free exchange is limited to the same product and colour in another available size.

It includes one consolidated exchange request, one return parcel and one standard outbound shipment of the replacement size.

The benefit may be used only once per order.

A second exchange, a request for another model or colour, or a mixed request containing both exchanges and products to be refunded is subject to the standard paid-return rules.

Products may be excluded from the free commercial exchange service where the exclusion is clearly communicated before purchase.

Such an exclusion does not affect statutory withdrawal rights.


17. REFUNDS

For a valid withdrawal concerning the entire order, Onyou will refund the price paid for the returned products and the cost of the least expensive standard outbound delivery method offered at the time of purchase.

Additional costs resulting from the customer’s choice of a more expensive delivery method will not be refunded.

For a partial withdrawal, the original outbound delivery cost will not normally be refunded where the same cost would have remained payable for the products retained by the customer, subject to mandatory applicable law.

Refunds will be issued using the original payment method unless another method is expressly agreed.

Onyou may withhold the refund until the returned products have been received or until the customer provides evidence that they have been shipped back, whichever occurs first.


18. DISCOUNTED PRODUCTS

Products purchased at a discounted price or during a promotion remain subject to the statutory right of withdrawal.

Discounted products may be excluded from the voluntary free size-exchange service only where the exclusion was clearly communicated before purchase.


19. LEGAL GUARANTEE OF CONFORMITY

Products sold to consumer customers are covered by the legal guarantee of conformity provided by the Italian Consumer Code and applicable European consumer law.

For new products, the legal guarantee lasts two years from delivery.

The seller is responsible for a lack of conformity existing at the time of delivery and manifesting within the applicable guarantee period.

Where legally applicable, the customer is entitled in the first instance to repair or replacement free of charge.

A proportionate price reduction or termination of the contract may be available in the circumstances provided by law.

The guarantee does not cover damage caused after delivery by improper use, accidents, normal wear and tear, incorrect maintenance, failure to follow care instructions or unauthorised modifications.

The legal guarantee cannot be excluded or restricted by these Terms or by any voluntary commercial service.


20. COMPLAINTS CONCERNING DAMAGED PARCELS

If a parcel appears damaged at delivery, the customer is invited, where reasonably possible, to:

- accept the parcel subject to reservation;
- record the visible damage with the carrier;
- retain the parcel and packaging;
- take photographs;
- contact Onyou promptly.

Failure to accept with reservation does not automatically remove any mandatory consumer right, but timely evidence may assist Onyou in handling the claim with the carrier.


21. CUSTOMER OBLIGATIONS

The customer agrees to:

- provide accurate, complete and current information;
- use valid payment information for which the customer is authorised;
- keep account credentials confidential;
- not use the website for fraudulent, unlawful or abusive purposes;
- not interfere with the operation or security of the website;
- not make purchases for unauthorised resale where the sale is offered exclusively to consumers.


22. INTELLECTUAL PROPERTY

Website content, including text, images, logos, graphics, product descriptions, design, layout, videos and software, is protected by intellectual-property and related laws.

The customer may use the website only for personal, non-commercial browsing and purchasing purposes.

No website content may be reproduced, distributed, altered, published, commercially exploited or used to create derivative works without prior permission from Onyou or the relevant rights holder.


23. THIRD-PARTY SERVICES AND LINKS

The website may contain links to or integrations with third-party services, including payment providers, delivery providers, social networks and review platforms.

Third-party services are governed by their respective terms and privacy notices.

Onyou is not responsible for third-party content or services outside its reasonable control, without prejudice to Onyou’s obligations as seller under applicable law.


24. WEBSITE AVAILABILITY

Onyou aims to keep the website accessible and accurate but does not guarantee uninterrupted or error-free operation.

The website may be temporarily unavailable for maintenance, updates, technical faults, security incidents or circumstances beyond Onyou’s control.

Onyou may modify or discontinue non-contractual website functions without affecting rights already acquired in relation to confirmed orders.


25. LIABILITY AND FORCE MAJEURE

Onyou is not liable for delay or failure caused by events beyond its reasonable control, including natural disasters, serious transport disruption, strikes, public-authority measures, network failure, cyber incidents, epidemics or interruption of essential third-party services.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

Nothing in these Terms excludes or limits mandatory consumer rights.


26. PRIVACY AND COOKIES

Personal data is processed according to the Privacy Policy published on the website.

Cookies and similar technologies are governed by the Cookie Policy and by the preferences selected through the website’s consent-management system.

The customer should include the order number and a clear description of the request.


28. ALTERNATIVE DISPUTE RESOLUTION

The European Online Dispute Resolution platform was discontinued on 20 July 2025 and is no longer available for submitting complaints.

Consumers may obtain information about available alternative dispute-resolution bodies through the competent national authorities and official European Union information channels.

Before starting formal proceedings, the customer may contact Onyou directly to seek an amicable resolution.


29. GOVERNING LAW AND COMPETENT COURT

These Terms are governed by Italian law, without prejudice to any mandatory and more favourable consumer-protection provisions applicable in the country in which the consumer habitually resides.

For disputes involving a consumer residing or domiciled in Italy, jurisdiction lies with the court of the consumer’s place of residence or domicile, where required by applicable law.

For customers who are not consumers, jurisdiction will be determined according to applicable law and any valid agreement between the parties.


30. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.


31. CHANGES TO THESE TERMS

Onyou may update these Terms to reflect legal, regulatory, technical, operational or commercial changes.

The version applicable to an order is the version made available to the customer when the order was placed.

The updated version will be published with the date of the latest revision.
