TERMS AND CONDITIONS OF SERVICE

These Terms and Conditions of Service govern purchases made on the Onyou website.

2. Scope of application

These terms apply to online sales of products made through the Onyou website to consumer customers.

Any sales to professionals, companies or resellers may be subject to different conditions.

The customer is invited to read these terms carefully before placing an order.

3. Products and availability

The essential characteristics of the products are indicated on the relevant product pages.

Images are for descriptive purposes and may differ slightly from the actual product due to color rendering, photography, screen settings or product updates.

Product availability is updated on the website but may vary. In the event of unavailability after the order has been placed, Onyou will inform the customer and propose an alternative solution, replacement or refund.

4. Prices

Prices are shown in euros.

Any shipping costs, free-shipping thresholds, taxes or additional costs are shown at checkout before the order is confirmed.

For shipments outside the European Union, customs duties, import taxes or customs charges may apply and are borne by the recipient, unless otherwise stated at checkout.

5. Order and conclusion of the contract

The customer selects the products, enters the required information and confirms the order through the checkout.

Before confirming the order, the customer can review the selected products, quantities, prices, shipping costs, billing and shipping details, and correct any input errors.

The contract is considered concluded when the customer receives the order confirmation at the email address provided.

Onyou reserves the right not to accept or to cancel orders in the event of incomplete or incorrect information, product unavailability, suspected fraud, obvious pricing errors or other relevant anomalies.

If an order is not accepted or is cancelled after payment, Onyou will refund any amount already paid by the customer.

6. Payments

Payment is made using the methods available at checkout.

In the case of payment through third-party services, the terms and conditions of the relevant provider also apply.

If Scalapay or another installment payment service is available, the customer acknowledges that the payment relationship may be managed by the relevant provider according to the terms indicated by that provider at checkout.

Payment must be successfully completed before the order can be processed and shipped.

7. Shipping and delivery

Shipping is governed by the Shipping Policy published on the website.

Unless otherwise agreed, Onyou delivers products without undue delay and in any event within 30 days from conclusion of the contract.

When transport is arranged by Onyou, the risk of loss or damage to the goods remains with Onyou until delivery to the customer or to a third party designated by the customer, other than the carrier.

If delivery is delayed, the customer may contact Onyou at info@on36071.it for assistance.

For shipments outside the European Union, customs duties, import taxes or charges requested by local authorities may apply and are borne by the recipient, unless otherwise stated at checkout.

8. In-store pickup

Where available, the customer may choose in-store pickup.

Onyou will inform the customer when the order is ready for pickup.

The customer may be asked to show the order confirmation and a valid identification document at the time of pickup.

9. Right of withdrawal, returns and refunds

Consumer customers have the right to withdraw from the contract within 14 days in the cases and according to the methods described in the Returns and Refunds Policy published on the website.

In the case of a valid withdrawal, Onyou will refund the payments received according to the timing and methods indicated in the Returns and Refunds Policy.

The customer must return the products without undue delay and in any event within 14 days from the communication of withdrawal.

In the case of withdrawal due to a change of mind, the direct cost of returning the goods is borne by the customer, unless otherwise stated by Onyou.

10. Exchanges

Size exchanges may be requested according to the procedure described in the Returns and Refunds Policy.

Exchanges are subject to product availability.

If the requested size or replacement product is not available, the customer may choose a refund where applicable.

11. Legal guarantee of conformity

Products sold to consumer customers are covered by the legal guarantee of conformity provided for by the Italian Consumer Code.

The guarantee lasts 2 years from delivery of the product.

In the event of a lack of conformity, the customer may contact Onyou at info@on36071.it, indicating the order number, a description of the defect and any useful documentation, including photographs where available.

Where the defect falls within the legal guarantee, the customer is entitled to have conformity restored free of charge, according to the remedies provided for by applicable law.

The legal guarantee does not cover damage caused by improper use, normal wear and tear, incorrect maintenance, unauthorized third-party intervention or causes not attributable to an original lack of conformity.

12. Customer obligations

The customer undertakes to provide accurate, complete and up-to-date information when placing an order or creating an account.

The customer is responsible for keeping account credentials confidential and for all activities carried out through the account, unless caused by Onyou’s fault or by circumstances outside the customer’s control.

The customer must not use the website for unlawful, fraudulent or abusive purposes, or in any way that may damage, disable or impair the website or interfere with its proper functioning.

13. Website content and intellectual property

All content on the website, including texts, images, logos, graphics, product descriptions, layout, design and other materials, is protected by applicable intellectual property laws.

The customer may use the website and its content only for personal and non-commercial purposes connected with browsing and purchasing products.

Any reproduction, distribution, modification, publication or use of website content for purposes other than personal use is prohibited without prior written authorization from Onyou or the relevant rights holder.

14. Promotions, discount codes and gift cards

Promotions, discount codes and special offers are valid only under the conditions indicated at the time of issue.

Discount codes may be subject to limitations, including expiry dates, minimum purchase amounts, product exclusions, customer restrictions or single-use limits.

Unless otherwise stated, promotions and discount codes cannot be combined with other offers.

Onyou reserves the right to modify, suspend or cancel promotions in the event of misuse, technical errors or circumstances that make continuation impossible or unfair, without prejudice to rights already acquired by consumers under applicable law.

15. Liability

Onyou is not liable for disruptions, delays or failure to perform caused by force majeure, unforeseeable events, third-party service interruptions, network or system malfunctions not under its control, or other causes beyond its reasonable control.

Nothing in these terms excludes or limits the mandatory rights recognized to consumers by applicable law.

16. Privacy and cookies

The processing of personal data is governed by the Privacy Policy published on the website.

The use of cookies and similar technologies is governed by the Cookie Policy and by the cookie preferences expressed by the user through the cookie banner or preference center.

18. Dispute resolution

The European ODR platform for online dispute resolution was discontinued on 20 July 2025.

For information on alternative consumer dispute resolution tools, consumers may consult the information channels made available by the European Commission and the competent authorities.

19. Applicable law and competent court

These terms are governed by Italian law, without prejudice to the consumer’s right to benefit from any mandatory and more favorable provisions of the country of habitual residence.

For disputes with consumer customers, the competent court is the court of the place of residence or domicile of the consumer, if located in Italy.

For non-consumer customers, where applicable, the competent court is determined by the applicable law and by any agreements between the parties.

20. Changes to these terms

Onyou may update these Terms and Conditions of Service to reflect legal, technical, commercial or organizational changes.

The version applicable to each order is the version available on the website at the time the order is placed.

The updated version will be published on this page with the date of last update.
